Shifted Terms & Conditions for Venues (Clients)
1.
Introduction
These Terms & Conditions (“Terms”) govern your use of the Shifted platform (“Platform”) as a Venue seeking to book hospitality workers (“Workers”). By creating a Venue account and posting shifts, you agree to these Terms.
2.
Definitions
Venue: A business or organisation using Shifted to book Workers.
Worker: An individual offering hospitality services through the Platform.
Booking: A confirmed shift between a Venue and a Worker.
Platform: The Shifted website and any associated services or applications.
Uniform: What the venue expects the designated worker to bring with them and be clothed in while working at their venue.
3.
Account Registration
You must provide accurate and complete business information when registering. You are responsible for all activity under your account.
4.
Use of the Platform
Venues may:
Post and manage shifts.
Select from verified Workers.
Communicate with Workers through the Platform.
Rate and review Worker performance.
Venues must not:
Circumvent the Platform to engage Workers off-platform without permission.
Post misleading or unlawful shift descriptions.
5.
Worker Engagement
All Workers engaged through Shifted act as independent contractors, not as employees of Shifted or the Venue. Venues agree:
To provide a safe working environment.
To honour agreed pay and shift times.
That Shifted is not liable for the conduct of Workers.
6.
Fees and Payments
Shifted charges a service fee for each completed Booking. Payment is processed via our secure system. You agree to:
Pay all invoices promptly.
Cover any cancellation fees as set out in the cancellation policy.
7.
Cancellations
Cancellations made by Venues within 24 hours of shift start may incur a cancellation fee - the full shifts wages plus service fee. Any shifts cancelled 24 hours before or more before the shift are free of charge. Persistent cancellations may lead to account suspension.
8.
Liability and Indemnity
Shifted is not liable for any loss, damage, or injury arising from services provided by Workers.
You agree to indemnify Shifted against claims arising from your use of the Platform or engagement with Workers.
9.
Data Protection
Both parties agree to comply with applicable UK data protection laws. Refer to our Privacy Policy for details on how data is collected and used.
10.
Termination
We reserve the right to suspend or terminate your account for breach of these Terms or misuse of the Platform.
Shifted Terms & Conditions for Workers
1.
Introduction
These Terms govern your use of the Shifted platform (“Platform”) as a Worker providing hospitality services. By signing up, you agree to be bound by these Terms.
2.
Definitions
Worker: A user offering hospitality services via Shifted.
Venue: A business or organisation that books Workers.
Booking: A confirmed shift between you and a Venue.
Platform: The Shifted app or website.
Uniform: What the venue expects the designated worker to bring with them and be clothed in while working at their venue.
3.
Account and Eligibility
To use the Platform, you must:
Be legally eligible to work in the UK.
Provide accurate personal and banking details.
Pass any required checks or verification steps.
4.
Independent Contractor Status
You are an independent contractor, not an employee of Shifted or the Venues. You:
Control when and where you work.
Are responsible for your own tax, National Insurance, and insurance obligations.
5.
Using the Platform
You agree to:
Show up on time to accepted shifts.
Follow reasonable instructions from the Venue during shifts.
Conduct yourself professionally and respectfully.
You must not:
Share your account with others.
Work under the influence of drugs or alcohol.
Contact Venues outside the Platform to seek off-platform work.
6.
Payment
Shifted pays you asa soon as possible for completed and verified shifts, this time can vary depending on the accuracy of clock-in/out procedures.
Your earnings will be subject to any service fees outlined in your worker dashboard.
7.
Cancellations and No-Shows
Cancellations must be made 48 hours before shift start. Cancellations within 48 hours can lead to permanent suspension on the platform.
No-shows will result in suspension or removal from the Platform.
8.
Ratings and Reviews
Venues can rate your performance. Continuous low ratings may affect your visibility on the Platform.
9.
Liability
Shifted is not responsible for any injury or loss incurred while working shifts.
You are responsible for your own safety and conduct while on-site.
10.
Data and Privacy
Your data is handled according to our Privacy Policy and in line with UK data protection law.
11.
Termination
Shifted may suspend or remove your account for breach of these Terms or poor conduct.
